Your Acceptance

  1. By using or visiting the Global Rockstar website you signify your agreement to (1) these Terms and Conditions and (2) Global Rockstar’s Rules of Participation. If you do not agree to any of these terms please do not use this Service.
  2. Although Global Rockstar may attempt to notify you when major changes are made to these Terms and Conditions, you should periodically review the most up-to-date version. Global Rockstar may, in its sole discretion, modify or revise these Terms and Conditions and policies at any time, and you agree to be bound by such modifications or revisions. Nothing in these Terms and Conditions shall be deemed to confer any third-party rights or benefits.

Services Provided

  1. These Terms and Conditions apply to all users of the Service, including users who embed Content from sites like YouTube and Vimeo. „Content“ includes video links from YouTube and Vimeo portraying musical performances of the users and text describing these musical performances.
  2. Global Rockstar hosts the Rio+20 Global Youth Music Contest organized by the International Association fort he Advancement of Innovative Approaches to Global Challenges (IAAI). The responsibility to abide by the terms of prize redemptions lies exclusively with IAAI (Dunajska 104, SI-1000 Ljubljana, Slovenia; Tel.:+38/61/568 41 68; Email: office @glocha.info; ZVR-Nr.: 918790591) which organizes all competitions associated with the Rio+20 Global Youth Music Contest.
  3. By embedding video links of your musical performances you enter the competitions for the Rio+20 Global Youth Music Song Contest and herewith guarantee to be available to perform at the Rio+20 United Nations Conference on Sustainable Development (Rio+20 Earth Summit) in Rio de Janeiro, Brazil from 20 June to 22 June 2012 in case you win the Global Youth Music Contest. There is not right of appeal.
  4. Therefore, the Service may contain links to third party websites that are not owned or controlled by Global Rockstar. Global Rockstar assumes no responsibility for the content, privacy policies, or practices of any third-party site. By using the Service, you expressly relieve Global Rockstar from any and all liability arising from your use of any third-party website.
  5. Accordingly, we encourage you to be aware when you leave the Service and to read the terms and conditions and privacy policy of each other website that you visit.

 General Use of Service – Permissions and Restrictions

In your use of the Service, you will comply with all applicable laws.

  • You agree that Global Rockstar reserves the right to stream advertisement before, during and after your music performance on video.
  • Global Rockstar reserves the right to discontinue any aspect of the Service at any time.

Your Use of Content

In addition to the general restrictions above, the following restrictions and conditions apply specifically to your use of Content.

  1. The Content on the Service, and the trademarks, service marks and logos („Marks“) on the Service, are owned by or licensed to Global Rockstar, subject to copyright and other intellectual property rights under the law.
  2. Content is provided to you as is. You may access Content for your information and personal use solely as intended through the provided functionality to the Service and as permitted under these Terms and Conditions. You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise, exploit any Content for any purposes without the prior written consent of Global Rockstar or the respective licensors of the Content. Global Rockstar reserves all rights not expressly granted in and to the Service and the Content.
  3. You agree not to circumvent, disable or otherwise interfere with security-related features of the Service or features that prevent or restrict use or copying of any Content or enforce limitations on use of the Service or the Content therein.
  4. You understand that when using the Service, you will be exposed to Content from a variety of sources, and that Global Rockstar is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such Content. You further understand and acknowledge that you may be exposed to Content that is inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Global Rockstar with respect thereto, and, to the extent permitted by applicable law, agree to indemnify and hold harmless Global Rockstar, its owners, operators, affiliates, licensors, and licensees to the fullest extent allowed by law regarding all matters related to your use of the Service.

Your Content and Conduct

  1. You shall be solely responsible for your own Content and the consequences of submitting and publishing your Content on the Service. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish Content you submit; and you license to Global Rockstar all patent, trademark, trade secret, copyright or other proprietary rights in and to such Content for publication on the Service pursuant to these Terms and Conditions.
  2. For clarity, you retain all of your ownership rights in your Content. However, by submitting Content to Global Rockstar, you hereby grant Global Rockstar a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service and Global Rockstar’s (and its successors’ and affiliates’) business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Service a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Service and under these Terms of Service. The above licenses granted by you in video Content you submit to the Service terminate within a commercially reasonable time after you remove or delete your videos from the Service. You understand and agree, however, that Global Rockstar may retain, but not display, distribute, or perform, server copies of your videos that have been removed or deleted. The above licenses granted by you in user comments you submit are perpetual and irrevocable.
  3. You further agree that Content you submit to the Service will not contain third party copyrighted material, or material that is subject to other third party proprietary rights.
  4. You further agree that you will not submit to the Service any Content or other material that is contrary to the Global Rockstar Rules of Participation, currently found at LINK, which may be updated from time to time, or contrary to applicable local, national, and international laws and regulations.
  5. Global Rockstar does not endorse any Content submitted to the Service by any user or other licensor, or any opinion, recommendation, or advice expressed therein, and Global Rockstar expressly disclaims any and all liability in connection with Content. Global Rockstar does not permit copyright infringing activities and infringement of intellectual property rights on the Service, and Global Rockstar will remove all Content if properly notified that such Content infringes on another’s intellectual property rights. Global Rockstar reserves the right to remove Content without prior notice.

Warranty Disclaimer

YOU AGREE THAT YOUR USE OF THE SERVICES SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, GLOBAL ROCKSTAR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF. GLOBAL ROCKSTAR MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SITE’S CONTENT OR THE CONTENT OF ANY SITES LINKED TO THIS SITE AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES. Limitation of Liability

IN NO EVENT SHALL GLOBAL ROCKSTAR BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU SPECIFICALLY ACKNOWLEDGE THAT GLOBAL ROCKSTAR SHALL NOT BE LIABLE FOR CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

The Service is controlled and offered by Global Rockstar from its facilities in Austria. Global Rockstar makes no representations that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so at their own volition and are responsible for compliance with local law.

Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Global Rockstar from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms and Conditions; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your Content caused damage to a third party. This defense and indemnification obligation will survive these Terms and Conditions and your use of the Service.

Ability to Accept Terms and Conditions

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and Conditions, and to abide by and comply with these Terms and Conditions.

Do not embed inappropriate content

Here are some common-sense rules that will help you to steer clear of troubles:

  • Global Rockstar is not for pornography or sexually explicit content. If this describes your video link, even if it’s a video of yourself, don’t post it on Global Rockstar. Also, be advised that we work closely with law enforcement and we report child exploitation.
  • Don’t embed video links showing bad stuff like animal abuse, drug abuse, under-age drinking and smoking, or bomb making.
  • Graphic or gratuitous violence is not allowed. If your video links show someone being physically hurt, attacked, or humiliated, don’t embed them.
  • Global Rockstar is not a shock site. Don’t post gross-out videos of accidents, dead bodies or similar things intended to shock or disgust.
  • Respect copyright. Only embed video links from videos that you made or that you are authorized to use. This means don’t embed video links from videos you didn’t make, or use content in your videos that someone else owns the copyright to, such as music tracks, snippets of copyrighted programs, or videos made by other users, without necessary authorizations.
  • We encourage free speech and defend everyone’s right to express unpopular points of view. But we don’t permit hate speech (speech which attacks or demeans a group based on race or ethnic origin, religion, disability, gender, age, veteran status, and sexual orientation/gender identity).
  • Things like predatory behavior, stalking, threats, harassment, intimidation, invading privacy, revealing other people’s personal information, and inciting others to commit violent acts or to violate the Terms and Conditions  are taken very seriously. Anyone caught doing these things may be permanently banned from Global Rockstar.
  • Everyone hates spam. Don’t create misleading descriptions, tags, titles or thumbnails in order to increase views. It’s not okay to post large amounts of untargeted, unwanted or repetitive content.

Please take these rules seriously and take them to heart. Don’t try to look for loopholes or try to lawyer your way around the guidelines – just understand them and try to respect the spirit in which they were created.

Assignment

These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Global Rockstar without restriction.

General

You agree that: (i) the Service shall be deemed solely based in Vienna, Austria; and (ii) the Service shall be deemed a passive website that does not give rise to personal jurisdiction over Global Rockstar, either specific or general, in jurisdictions other than the Federal Republic of Austria. These Terms Conditions shall be governed by the internal substantive laws of the Federal Republic of Austria, without respect to its conflict of laws principles. Any claim or dispute between you and Global Rockstar that arises in whole or in part from the Service shall be decided exclusively by a court of competent jurisdiction located in Vienna, Austria. These Terms and Conditions, together with the Rules for Participation and any other legal notices published by Global Rockstar on the Service, shall constitute the entire agreement between you and Global Rockstar concerning the Service. If any provision of these Terms and Conditions is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any term of this these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term, and Global Rockstar’s failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. Global Rockstar reserves the right to amend these Terms and Conditions at any time and without notice, and it is your responsibility to review these Terms and Conditions for any changes. Your use of the Service following any amendment of these Terms and Conditions will signify your assent to and acceptance of its revised terms.
